01. Agreement to Terms

These Terms of Service (“Terms”) govern your use of the LuxStyle Real Estate Media website at luxstylerem.com and the professional photography, videography, and media production services provided by LuxStyle Real Estate Media (“LuxStyle,” “we,” “us,” “our”).

By accessing our website, submitting a booking request, or engaging our services, you (“Client”) agree to be bound by these Terms. If you do not agree, please do not use our website or services.

02. Services

LuxStyle Real Estate Media provides professional real estate photography, drone/aerial photography and videography, cinematic listing videos, agent brand reels, and associated media production services for residential and commercial properties in the Sacramento and Placer County regions of California.

All services are subject to availability. LuxStyle reserves the right to decline any booking request at its discretion.

03. Booking & Scheduling

A booking is confirmed upon receipt of payment or written confirmation via email. The Client is responsible for ensuring property access, readiness, and staging prior to the scheduled shoot time.

04. Cancellation & Rescheduling

• Cancellations with 24+ hours notice: Full credit toward rescheduling; no cancellation fee.
• Cancellations with less than 24 hours notice: A cancellation fee of 50% of the booking total may apply.
• Same-day cancellations or no-shows: Full booking fee may be charged.
• Weather-related cancellations: Exterior shoots may be rescheduled at no charge due to weather conditions at LuxStyle’s discretion.

05. Payment Terms

Payment is due as outlined at the time of booking. LuxStyle reserves the right to withhold delivery of final media files until payment is received in full. Invoices not paid within 14 days of delivery may incur a late fee of 1.5% per month.

Accepted payment methods include major credit cards and other methods specified at checkout. All prices are in US dollars.

06. Deliverables & Delivery

LuxStyle will deliver edited photographs and/or video files within the timeframe communicated at booking, typically within 24–72 hours of the shoot for standard photography packages. Rush delivery options may be available for an additional fee.

Files are delivered digitally via download link. LuxStyle retains raw/unedited files and is not obligated to provide them. Download links are active for a limited period; it is the Client’s responsibility to download and back up all delivered files promptly.

08. Intellectual Property & Licensing

LuxStyle Real Estate Media retains full copyright ownership of all photographs, videos, and media created during any engagement. Upon receipt of full payment, LuxStyle grants the Client a non-exclusive, non-transferable license to use the delivered media for the following purposes:

• Real estate listing and marketing for the specific property photographed
• The listing agent’s personal portfolio and marketing materials
• Social media promotion of the specific property

The following uses are not permitted without written consent from LuxStyle:

• Resale or sublicensing of images to third parties
• Use in advertising, editorial publications, or commercial campaigns unrelated to the specific property
• Modification or derivative works beyond standard platform formatting

LuxStyle reserves the right to use delivered media in its portfolio, website, social media, and marketing materials unless the Client provides written opt-out notice prior to the shoot.

09. Drone & Aerial Services

Drone photography and videography is subject to FAA regulations and local airspace restrictions. LuxStyle operates with proper FAA Part 107 certification. Drone flights are subject to weather conditions, airspace authorization, and other factors outside our control. LuxStyle will reschedule drone portions of a shoot at no charge if conditions prevent safe or legal flight.

The Client is responsible for obtaining any necessary HOA or property-specific permissions for drone flights.

10. Limitation of Liability

LuxStyle Real Estate Media’s total liability to the Client for any claim arising from services rendered shall not exceed the total amount paid by the Client for the specific project giving rise to the claim.

LuxStyle is not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to lost profits or revenue, delays in listing, or property sale outcomes.

11. Indemnification

The Client agrees to indemnify and hold harmless LuxStyle Real Estate Media, its team members, and agents from any claims, losses, or expenses (including reasonable attorney’s fees) arising from the Client’s use of delivered media in violation of these Terms, applicable law, or MLS/real estate regulations.

12. Governing Law

These Terms are governed by the laws of the State of California without regard to conflict of law principles. Any disputes shall be resolved in the courts of Sacramento County, California.

13. Changes to These Terms

LuxStyle reserves the right to update these Terms at any time. Changes take effect upon posting to this page. Continued use of our services following any update constitutes acceptance of the revised Terms.
